2.0 Payments for Products

You can pay for products over the Internet on our site. You can do so using a credit card, PayPal or any other method we choose to offer on the site. PETAMPLIFE.COM does not handle or see your credit card payment information.

In providing you with online payment platforms, we select well-known third-party payment processing and transaction service providers. However, PETAMPLIFE.COM cannot guarantee their service or security and you agree that PETAMPLIFE.COM will not be responsible for any lapses or liability arising solely from the payment processor’s actions.

All prices are listed in USD. Currency conversion fees may apply if you are paying in a different currency.

 

3.0 Shipping of Goods

Shipping rates, duties, and taxes will be listed when you process your purchase and before you finalize the order. These shipping charges vary from time to time so please review carefully. Shipping fees are subject to change at any time at PETAMPLIFE.COM’s discretion and without prior notice.

For international shipments, additional duties and taxes may be due at border crossing and will be solely the responsibility of the customer. PetAmpLife is not responsible for any product or packages returned to sender or lost due to the duties and taxes not being paid in time from allotted from the border.

It is the customer's responsibility to ensure that the products ordered are permissible in Canada. Please check with local authorities regarding any restrictions or regulations.

The shipping timelines provided on our website during the checkout process represent the most accurate estimates for when your order will be delivered. It's important to note that these estimates refer to the time it takes for your order to be shipped, not the time it takes for your order to be processed.

If you qualify for and choose the free shipping option during checkout, it's important to understand that the selection of both the shipping service and carrier is at our discretion.

This means that while we strive to provide the best possible shipping service and carrier for your order, the final decision regarding which carrier to use for free shipping is made by us. Factors such as order volume, destination, and carrier availability may influence this decision.

While we provide estimated transit times for deliveries, it's important to recognize that these are the best estimates and can vary based on several factors. 4.0 Prohibited Conduct

While using PETAMPLIFE.COM sites, blogs, public forums, services and tools, you will not:

• post content or items in an inappropriate category or areas on our sites;

• violate any laws, third party rights or our policies;
• use our sites if you are not able to form legally binding contracts, are under the age of 18, or are temporarily or indefinitely suspended from using our sites or services;

• circumvent or manipulate our fee structure, the billing process, or fees owed to PETAMPLIFE.COM;
• post false, inaccurate, misleading, defamatory, or libelous content (including personal information);

• take any action that may undermine the feedback or ratings systems (such as displaying, importing or exporting feedback information off the sites or using it for purposes unrelated to PETAMPLIFE.COM);
• distribute or post spam, unsolicited, or bulk electronic communications, chain letters, or pyramid schemes;
• transfer an PETAMPLIFE.COM account to another party without our written consent;
• distribute viruses or any other technologies that may harm PETAMPLIFE.COM, or the interests or property of PETAMPLIFE.COM users;
• copy, modify or distribute rights or content from the PETAMPLIFE.COM sites, service or tools or PETAMPLIFE.COM’s copyrights and trademarks;
• harvest or otherwise collect information about users, including email addresses, without their consent.
• Access or use the site from or by a national or resident of any country to which the U.S. has embargoed services.
• Access or use the site if you are a person or entity appearing on the Office of Foreign Assets Control's Specially Designated Nationals and Blocked Persons List or the Bureau of Industry and Security's Denied Persons List.

Without limiting other remedies, we may limit, suspend or terminate our service and user accounts, prohibit access to our sites and their content, and take technical and legal steps to keep users off the sites if we think that they are creating problems or possible legal liabilities, infringing the intellectual property rights of third parties, or acting inconsistently with the letter or spirit of our policies (for example, and without limitation, policies related to shill bidding, conducting off- PETAMPLIFE.COM transactions, feedback manipulation, circumventing temporary or permanent suspensions or users who we believe are harassing our employees or other users). Additionally, we may, in appropriate circumstances and at our discretion, suspend or terminate accounts of users who may be repeat infringers of intellectual property rights of third parties. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for a long time, or to modify or discontinue PETAMPLIFE.COM sites or services. All software used on this site (the "Software") is the property of PETAMPLIFE.COM, its licensor or its affiliates. The Content, the Compilation and the Software are all protected by U.S. and international copyright laws. PETAMPLIFE.COM and other logos, slogans, trade names or trademarks that appear on the PETAMPLIFE.COM site or on PETAMPLIFE.COM branded products are registered trademarks, trademarks or service marks of PETAMPLIFE.COM, its licensor or its affiliates. The use of any of our trademarks or service marks, or confusingly similar imitations thereof, including but not limited to use on products or services, without our express written consent is strictly prohibited. You may not use our trademarks or service marks in connection with any product or service in any way that is likely to cause confusion. 6.3 PETAMPLIFE.COM Charges and Services

We may choose to temporarily change the fees for our goods and services for promotional events, and such changes are effective when we post the temporary promotional event or new service on the sites. Unless otherwise stated, all prices are quoted in U.S. Dollars. You are responsible for paying all prices and applicable taxes and/or import duties associated with products that you purchase in a timely manner with a valid payment method. If your payment method fails, we may collect fees owed using other collection mechanisms. (This includes charging other payment methods on file with us, retaining collection agencies and legal counsel, and for accounts over 180 days past due, deducting the amount owed from your PayPal account balance.) If we are forced to take any legal actions for failure to make payment in whole or in part, the prevailing party in the action will be entitled to attorney’s fees and costs incurred including but not limited to any demand letters, pre-litigation legal services, lawsuits, arbitrations, mediations, and appeals.

6.4 Posted Content

When you post content to the sites in the form of images, reviews, comments or recommendations, you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub licensable (through multiple tiers) right to exercise any and all copyright, trademark, publicity, and database rights (but no other rights) you have in the content, in any media known now or in the future.

 

7.0 Returns

Prior to returning any products for any reason, the customer must contact PetAmpLife at support@petamplife.com to obtain a Return Authorization Number (RA). No refund will be issued for any product returned without an RA number. Any product returned to PetAmpLife cannot be resent to original customer.

PetAmpLife does not refund or provide return credits for opened or used products. PetAmpLife does not provide any refunds after 30 days from the date of purchase. The product must be returned to PetAmpLife in its original condition. Customer must pay return shipping costs. If return is authorized, return credits will be provided less the initial shipping and handling costs.

No returns for international customers.

If you receive any products in a damaged condition, hang on to your shipment and DO NOT discard any damaged boxes, packaging, or products. Report the damage to us and we will determine if you should return the product for a replacement. You may be asked to provide pictures of your damages to help in the processing of your claim.

·       Returns need to be approved before shipment and provided an RA number or opportunity for refund will not be applicable.

·       If we feel you are abusing the returns process, we reserve the right to deny the return request and terminate your account.

·       Any order errors — including mis-shipments, missing items, damaged items, packages marked delivered but not received, etc. — must be reported within 30 days of order delivery to receive resolution or correction.

·       PetAmpLife does not accept returns due to market changes or Customer’s inability to sell the product due to a lack of compliance with the advertised pricing policies or internet selling restrictions.

·       PetAmpLife is not responsible for lost/stolen packages or customs fees. The customer needs to reach out to the carrier for further resolution.

 

7.1 Risk of Loss; Other Terms of Sale

The risk of loss and title for items purchased by you pass to you upon our delivery of the items to the carrier. We do not take title to returned items until the item arrives at our fulfillment center. At our discretion, a refund may be issued without requiring a return. In this situation, we do not take title to the refunded item.

 

7.2 Product Warranties

PETAMPLIFE.COM products do not come with any warranties except as expressly listed on the product packaging, and any disclaimers set forth on such product packaging apply to such product.

 

8.0 Product Information

THE CONTENT ON PETAMPLIFE.COM IS NOT INTENDED AS MEDICAL ADVICE OR FOR DIAGNOSIS. PRODUCT INFORMATION SHOULD NEVER BE USED AS A SUBSTITUTE FOR CONSULTATION WITH YOUR PHYSICIAN.

 

9.0 The Limitation of Liability

THIS SITE AND THE TRANSACTIONS CONDUCTED THROUGH IT ARE PROVIDED BY US ON AN "AS IS" BASIS. YOU WILL NOT HOLD PETAMPLIFE.COM RESPONSIBLE FOR THIRD PARTY CONTENT, MISCONDUCT, ACTIONS OR INACTIONS. 9.2 Indemnity

You will indemnify and hold us (and our officers, directors, agents, subsidiaries, joint ventures and employees) harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of this User Agreement, or your violation of any law or the rights of a third party.

10.0 General

• Entire User Agreement. This User Agreement (which includes our Privacy Policy) constitutes the entire agreement between you and PETAMPLIFE.COM and governs your use of the site, superseding any prior or contemporaneous agreements, proposals, discussions, or communications between you and PETAMPLIFE.COM on the subject matter hereof.
• Modification. PETAMPLIFE.COM may update this User Agreement at any time and from time to time by posting such updates on this web page. PETAMPLIFE.COM reserves the right to modify this User Agreement and the Privacy Policy at any time. You are responsible for checking the site from time to time to review any changes and you will be responsible to abide by any changes. If an amendment or update changes how we use your Personal Information or applicable law otherwise requires your consent, we will also seek your consent prior to such update applying to you. Upon providing notice as noted above, amendments and updates which do not require your consent will be effective regardless of whether your consent is obtained.
• Waiver. The failure or delay of PETAMPLIFE.COM to exercise or enforce any right or provision of this User Agreement shall not constitute a waiver of such right or provision. No oral waiver, amendment or modification shall be effective under any circumstance whatsoever.
• Binding Effect. Except as expressly provided in this User Agreement, nothing in this User Agreement will confer any rights or remedies under or by reason of this User Agreement on any person or entity other than the Parties and their respective successors and permitted assigns.
• No Assignment. You shall not assign this User Agreement, or any right or obligation pursuant to this User Agreement, without the prior written consent of PETAMPLIFE.COM.
• Agreement to Be Bound and Survival. Your agreement to be bound by this User Agreement commences with the accepting of this User Agreement, you're accessing or using the site, or otherwise submitting information to PETAMPLIFE.COM through the site. Your agreement to be so bound will continue until this User Agreement is terminated pursuant to the terms of this User Agreement or your right to access and use the site is terminated, subject to the survival of each of each of the provisions of this User Agreement which by their nature are intended to survive the termination of this User Agreement.
• Counterparts and Electronic Versions. This User Agreement may be accepted in multiple counterparts, each of which shall be deemed to be an original and of equal force and effect, and all of which taken together shall constitute one and the same instrument. This User Agreement may be accepted in electronic format and/or with digital signatures, each party reserves the right to maintain an accepted copy of this User Agreement in electronic form only, and each party hereby agrees that a print-out of such electronic form of this User Agreement will be deemed an original for all purposes relating to the enforceability of the terms and conditions of this User Agreement.

 

10.1 FORCE MAJEURE

·       PetAmpLife shall not be liable to the Customer for any damages or failure to make delivery in respect of any orders accepted by PetAmpLife for the production or sale of any products where such failure is due to fire, strike, labor trouble, accident to machinery, power failure, inability to obtain raw materials, war, epidemic or pandemic, quarantine restrictions, lack of or failure of transportation, delay in delivery or defects in goods supplied by PetAmpLife’s suppliers or subcontractors, act of God, regulations of any governmental authority, incorrect, delayed, or incomplete information provided by the Customer, or any cause or condition beyond the reasonable control of PetAmpLife.

·       Further, the occurrence of any such circumstance shall operate to extend PetAmpLife’s time of performance hereunder for a period not less than the period of delay caused by such circumstances. In the event of any such circumstance, PetAmpLife may allocate its production and deliveries among its customers as it may decide in its sole discretion.

 

10.2 Subscription Terms and Conditions

 

These Subscription Terms and Conditions ("Agreement") govern your use of our subscription service ("Service") offered by [PetAmpLife] ("we" or "us"). By subscribing to our products, you agree to be bound by the following terms and conditions:

V.     This Agreement represents the entire understanding between you and PetAmpLife regarding your subscription to the product(s) and supersedes any prior agreements, whether written or oral.

By subscribing to our Service, you acknowledge that you have read, understood, and agreed to these Subscription Terms and Conditions.

 

11.0 MAP Policy

PetAmpLife has determined that certain advertising practices undermine PetAmpLife’s trade reputation and brand within the target consumer population and discourage PetAmpLife’s resellers from investing in the PetAmpLife product lines and providing the best possible service and support to patients, including nutritional consultation and other services.  Accordingly, PetAmpLife has adopted this unilateral Minimum Advertised Price Policy (the “Policy”), which applies to all authorized resellers of PetAmpLife.

PetAmpLife is solely responsible for establishing the minimum advertised price (“MAP”) for each Product and communicating the MAP to all resellers. While resellers remain free to sell all PetAmpLife Products at any price, they deem appropriate, it is a violation of this Policy for a reseller to advertise any Product at a price lower than MAP.  Such advertisements include, but are not limited to:

A.    Offering coupons, discounts, reseller rebates, or other inducements that, when applied, result in a price lower than the MAP, including through use of a storewide sale, promotional code, or other similar provision that can be applied to Products.

B.     Bundling Products with other products or services (whether made by or provided by PetAmpLife or another entity) in a manner that implies below-MAP pricing for the bundled PetAmpLife Product.

C.     Strikeouts or strikethroughs of pricing information on non-subscription orders.

Direct or indirect attempts to circumvent this Policy also violate this Policy.

For purposes of this Policy, the terms “advertise” and “advertisement” include all promotional or pricing information displayed via any type of media, including, but not limited to, website pages and banners, social media, emails, blogs, newspapers, catalogs, magazines, flyers, brochures, television, radio ads, billboards, signage (except signs displayed within a brick-and-mortar selling location), affiliate marketing networks/comparison shopping engines, reseller-initiated text messages or emails to prospective customers, mobile/smart phone applications, online product ads, paid search ads, pay-per-click ads, display ads, mobile ads, product listing ads, sponsored links, ads in any other media in a digital format that is communicated or conveyed via the Internet, and any other marketing or promotional materials, whether displayed online or through broadcast or other media.

Notwithstanding the foregoing, pricing information displayed at the final online checkout stage of a transaction is not considered “advertising” under this Policy.  The “final online checkout stage” is the stage when the Product is put into a shopping cart that contains the customer’s name, shipping address, email address, and payment information.  Pricing information in the “shopping cart” or “checkout” stages must be obscured technically so that it is not retrievable by shopping and pricing engines, and not displayed on search page results within the reseller’s own website.

 

From time to time, PetAmpLife may announce MAP holidays or promotions that are applicable to all resellers, during which periods a reseller that advertises an PetAmpLife product in accordance with the terms of the authorized promotion will not be deemed to have violated the Policy. PetAmpLife will notify all resellers of any such authorized promotions, generally not fewer than thirty (30) days in advance.

 

This Policy does not constitute an agreement between PetAmpLife and any other entity.  PetAmpLife neither solicits nor will it accept any assurance of compliance with this Policy from any reseller or other party.  Each reseller must independently choose whether to comply with the terms of this Policy.  This Policy is not negotiable and will not be altered for any individual reseller.  This Policy applies only to advertised prices and does not affect the prices that a reseller may charge for PetAmpLife Products.

 

11.1 NON-COMPLIANCE

 

PetAmpLife will take the following actions against any reseller that fails to comply with this Policy with respect to the advertisement of any Product:

A.    For a reseller’s first violation of the Policy, PetAmpLife will notify the reseller in writing of such failure and will immediately place the reseller’s account on shipping hold until violation is corrected.  PetAmpLife will revoke its acceptance of any pending orders, cancel any pending shipments to the reseller, and not accept any new orders from the reseller during this period.

B.     For a reseller’s repeated violation of the Policy, PetAmpLife reserves the right to suspend or terminate its business relationship with the reseller. PetAmpLife will revoke its acceptance of any pending orders and cancel any pending shipments to the reseller

 

Although PetAmpLife is not directing any reseller to require that its customers comply with this Policy, a violation of this Policy by a customer will constitute a violation by the reseller.

 

The Policy will be enforced by PetAmpLife in its sole discretion and without notice.

 

11.2 POLICY ADMINISTRATION

 

PetAmpLife may update, revise, suspend, terminate, reinstitute, or modify this Policy at any time in its sole discretion.  PetAmpLife shall make any such modifications available to all authorized resellers.  If PetAmpLife changes the MAP on any Product, it will provide at least 30 days notice to resellers before such a change takes effect.   

No PetAmpLife employee or agent, including a reseller’s sales representative, is authorized to modify, interpret, or grant exceptions to this Policy; solicit or obtain the agreement of any person to this Policy; or otherwise discuss any aspect of this Policy with any reseller, including that resellers or any other reseller’s compliance with the terms of the Policy.  Any questions about this Policy should be submitted in writing and directed to PetAmpLife Customer Support Team at suport@petamplife.com.  PetAmpLife will accept no other form of communication from resellers regarding the Policy.

This Policy is effective April 1, 2024, and supersedes all prior PetAmpLife policies and/or representations regarding minimum advertised prices or resale prices for PetAmpLife Products applicable to any reseller.  To the extent that any provision, term, or agreement governing the relationship between PetAmpLife and any reseller may be construed in a manner that is inconsistent with the terms of this Policy, the terms of this Policy control.
